1. About These Terms
These Terms of Service ("Terms") govern your use of the software products and services provided by ClickDigit ("we", "our", or "us"), a software business based in Melbourne, Victoria, Australia. By accessing or using any ClickDigit product, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use our services. We may update these Terms from time to time — we'll notify you of significant changes via email or a notice in the product.
2. Our Services
ClickDigit provides web-based software products designed for small businesses. Our products include (but are not limited to) tool and equipment tracking, task and job management, and client relationship management software.
Some products may be in early access or beta. We'll always be transparent about the development status of what you're using.
3. Your Account
To use ClickDigit products, you may need to create an account. You are responsible for:
- Providing accurate and current information when registering
- Keeping your login credentials secure and confidential
- All activity that occurs under your account
- Notifying us promptly if you suspect unauthorised access
You must be at least 18 years old to create an account. Accounts are for individual use unless a team or multi-seat plan is explicitly offered.
4. Acceptable Use
You agree to use ClickDigit products only for lawful purposes. You must not:
- Attempt to reverse-engineer, decompile, or extract source code from our software
- Use our services to store or transmit illegal, harmful, or offensive content
- Attempt to gain unauthorised access to any system, account, or data
- Use automated tools to scrape or overload our services
- Resell or sublicense access to our products without written permission
We reserve the right to suspend or terminate accounts that violate these rules, without prior notice in serious cases.
5. Payment & Subscriptions
During early access, products may be offered free of charge or at a discounted founder rate. Paid plans will be clearly communicated before any charge is made. We will never charge your payment method without your explicit agreement.
If you subscribe to a paid plan, you may cancel at any time. Cancellations take effect at the end of the current billing period. We do not offer refunds for partial periods unless required by Australian consumer law.
6. Intellectual Property
All software, designs, and content within ClickDigit products remain the intellectual property of ClickDigit. Nothing in these Terms grants you ownership of our software.
You retain ownership of all data you input into our products. We do not claim any rights over your business data.
7. Limitation of Liability
To the maximum extent permitted by law, ClickDigit is not liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or business opportunities — arising from your use of our products.
Our total liability to you for any claim will not exceed the amount you paid us in the three months preceding the claim. Nothing in these Terms limits liability that cannot be excluded under Australian Consumer Law.
8. Service Availability
We aim for high availability but cannot guarantee uninterrupted access. We may perform maintenance, updates, or experience outages. We will provide advance notice of planned downtime where possible.
9. Termination
You may stop using our products at any time. We may suspend or terminate your access if you breach these Terms, or if we discontinue a product — in which case we will provide reasonable notice and assist with data export where possible.
10. Governing Law
These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria. For disputes involving Australian Consumer Law, the standard protections under Commonwealth law apply.
